CITY OF TIFFIN IOWA ORDINANCE NO. 2019-447 AN ORDINANCE TO AMEND THE TIFFIN ZONING ORDINANCE NO. 2007-287 TO ALLOW THIRD STORY APARTMENTS TO THE C-1S, COMMERCIAL SPECIALIZED DISTRICT DOWNTOWN CENTER BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend Zoning Ordinance No. 2007-287, C-1S, Commercial Specialized District Downtown Center by allowing third story apartments to the district. Section 2. Amendment. C-1S .01 and C-1S .02, Commercial Specialized District Downtown Center is amended as follows: See attachment. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 4. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 22nd day of January 2019, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2019-447, and moved that it be given its second reading. The motion was seconded by Councilperson Schnedler. Ayes: Upton, Ryan, Havens, Bartels, Schnedler Nays: None On the 5th day of February 2019, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2019-447, and moved that it be given its first reading. The motion was seconded by Havens. Ayes: Havens, Bartels, Upton, Schnedler, Ryan Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2019-447, was read the first time, discussed, and placed on record.
