EASEMENT AGREEMENT This agreement made and entered into by and between Clear Creek Community School District of Tiffin, Iowa, owner of the real estate described herein, (hereinafter referred to as First Party, which expression shall include, his, her or their heirs, agents, successors or assigns), and CITY OF TIFFIN, IOWA, a municipal corporation, (hereinafter referred to as Second Party, which expression shall include their agents, successors or assigns), witnesseth: It is hereby agreed as follows: For the sum of $1.00 plus other valuable consideration, the receipt of which is hereby acknowledged, First Party hereby grants and conveys to Second Party an easement for the purposes of constructing storm sewer and drainage ditch and the installation, replacement, maintenance and use of such pipes and conduits as Second Party shall from time to time elect for the purposes of conveyance of storm waters with all necessary appliances and fittings for use in connection with said storm sewer and drainage ditch, together with adequate protection therefore, and also a right of way, with the right of ingress and egress thereto, including all the area described as follows: Commencing at the northeast corner of the property (said First Party property which contains a parking lot and said corner is located on the west line of Lot 3 in Sadler Subdivision in Tiffin, Johnson County, Iowa); thence south along the said west line of Lot 3, 21 feet more or less to the Point of Beginning; said Point of Beginning is the centerline of a 10 foot wide easement for the installation of 18-inch diameter reinforced concrete storm sewer piping and appurtenances; thence westerly and parallel to the north line of said tract, 48 feet more or less to a point; thence northerly and parallel to the said west line of Sadler Subdivision, 14 feet more or less; thence southerly and parallel to the said west line of Sadler Subdivision, 267 feet more or less; thence southeasterly, 83 feet more or less to the existing open discharge ditch. First Party further grants to Second Party: 1. The right of excavating said strip for the full width thereof and to extend the cuts and fills for such excavating into and on said lands along and outside of the said line to such extent as Second Party may find reasonably necessary; 2. The right from time to time to trim and cut down and clear away any and all trees and brush now or hereafter on said strip and to trim and to cut down and clear away any trees on either side of said strip which now or hereafter in the opinion of Second Party may be a hazard to said berms/ditches or may interfere with the
