CITY OF TIFFIN ORDINANCE NO. 2021-488 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF TIFFIN, IOWA, SECTION 55.01(8) of CHAPTER 55, ANIMAL PROTECTION AND CONTROL, DEFINITION OF POULTRY BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section 1. Purpose: The purpose of this ordinance is to amend the municipal code of Tiffin to clarify the definition of poultry in section 55.01(8) of chapter 55, animal protection and control. Section 2. Amendment. Section 55.01(8) of Chapter 55 is hereby amended as follows: CHAPTER 55 ANIMAL PROTECTION AND CONTROL 55.01 DEFINITIONS. The following terms are defined for use in this chapter. 8. “Livestock” means an animal belonging to the bovine, caprine, equine, ovine or porcine species, ostriches, rheas and emus; farm deer as defined in Section 170.1 of the Code of Iowa; or poultry except for chickens that are members of the subspecies Gallus Gallus Domesticus that are being kept in compliance with a valid permit approved in Chapter 58. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 16th day of November 2021, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2021- 488, and moved that it be given its first reading. The motion was seconded by Councilperson Bartels. Ayes: Bartels, Schnedler, Limkemann, Havens, Olney Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2021-488, was read the first time, discussed, and placed on record.
